These Terms of Use ("Terms") govern access to and use of the PediaPulse public website and services provided by ProParenting Pulse LLC ("ProParenting Pulse," "PediaPulse," "we," "us," or "our"). By accessing or using PediaPulse, you agree to these Terms.
PediaPulse provides educational and communication tools for healthcare organizations, clinicians, staff, parents, and guardians. Current services may include PediaPulse Education and PediaPulse Connect. Features may be introduced, changed, suspended, or discontinued over time.
PediaPulse does not provide medical advice, diagnosis, treatment, emergency care, or establish a doctor-patient relationship with ProParenting Pulse LLC. Educational materials do not replace the judgment or instructions of a licensed healthcare professional.
Do not use PediaPulse to seek emergency assistance. Call 911 or the appropriate emergency service for an emergency. Contact the treating clinic for medical questions.
Healthcare organizations and authorized users are responsible for:
Parents and guardians should follow the instructions of the child's treating clinician. If PediaPulse content conflicts with direct instructions from the treating clinician, contact that clinician for clarification.
You may not use PediaPulse to:
Authorized clinic features may require an account and multi-factor authentication. Users must provide accurate information, protect credentials, and promptly report suspected unauthorized access. We may suspend access when reasonably necessary to protect users, clinics, recipients, or the service.
PediaPulse, its branding, software, design, and original content are owned by or licensed to ProParenting Pulse LLC and are protected by applicable intellectual-property laws. Except as expressly permitted, no rights are granted to copy, modify, distribute, sell, or create derivative works from PediaPulse.
PediaPulse may rely on third-party hosting, communications, authentication, or other service providers. We are not responsible for third-party services outside our control, except as required by law or contract.
We work to provide a reliable service but do not guarantee uninterrupted or error-free availability. Early-access or pilot features may change and may not be suitable for every workflow.
To the fullest extent permitted by law, PediaPulse is provided on an "as is" and "as available" basis. We disclaim warranties not expressly provided in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, ProParenting Pulse LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, or goodwill arising from use of or inability to use PediaPulse. Any additional liability terms in a signed agreement with a clinic control for that clinic.
Some jurisdictions do not allow certain exclusions or limitations, so some provisions may not apply.
We may suspend or terminate access when these Terms are violated or when reasonably necessary for security, legal compliance, or protection of users and the service. Obligations that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where applicable law requires otherwise.
We may update these Terms. The updated version will be posted with a revised effective date. Continued use after an update constitutes acceptance to the extent permitted by law.
